"Join the Waitlist" allows you to express your interest in future Constant Contact products, services, or promotions.

Registering for the waitlist does not guarantee that Constant Contact will offer, manufacture, or deliver any specific product or service to you. Your registration is merely an expression of interest and does not constitute a legally binding contract for sale or service.

You may be placed in a queue based on the order of your registration. However, Constant Contact reserves the right to prioritize communication and offers based on various factors, including but not limited to the order of registration, strategic planning, or other criteria determined solely by Constant Contact. Constant Contact is not bound by the waitlist order.

The waitlist is open only to new customers who have not previously subscribed to, or utilized, any paid or free version of Constant Contact's products or services. We reserve the right to determine eligibility at our sole discretion. If you are an existing or past customer, you are not eligible to join this waiting list.

You must be at least 18 years old and capable of forming a binding contract under applicable law.

Joining the Waitlist does not require any financial commitment or payment from you. No financial transaction or payment will occur until you formally agree to purchase a product or service under separate terms and conditions.

Constant Contact reserves the right to modify, withdraw, or discontinue any offers, promotions, or pricing that may have been applicable at the time of "Joining the Waitlist" at its sole discretion. You will not have any deemed right to such offers or pricing if they are later discontinued.

By joining the waitlist, you agree that Constant Contact and/or its representatives may contact you to confirm your continued interest in Constant Contact products, services, or promotions. Communications may be made via email or phone, or other methods deemed suitable by Constant Contact.

You are responsible for providing accurate and current contact details. Constant Contact shall not be responsible for non-receipt of any communication, confirmation, or acknowledgment due to incorrect contact details provided by you.v

Constant Contact reserves the right to change, alter, or modify its products, services, specifications, features, and/or pricing without prior notice. Constant Contact also reserves the right to change, alter, or modify these Waitlist Terms at its sole discretion without prior notice.

Constant Contact collects, stores, processes, and uses your information in accordance with its Privacy Policy. By joining the Waitlist and/or providing your personal information, you consent to Constant Contact collecting, handling, processing, and using your information as described in the Privacy Policy.

Constant Contact, its affiliates, directors, employees, consultants, business partners, and agents assume no liability whatsoever for any direct, indirect, incidental, or consequential loss or damage arising to you due to "Joining the Waitlist."

You agree to indemnify, defend, and hold harmless Constant Contact against all claims, losses, damages, or costs that may be incurred or suffered by Constant Contact arising out of any breach of these Waitlist Terms by you or due to your fraud, willful misconduct, or negligence.

These Waitlist Terms shall be governed by the laws of the State of Massachusetts, United States, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Waitlist Terms shall first be attempted to be settled through good faith discussions between the parties. If a dispute cannot be resolved through mutual discussions, it shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, with the arbitration taking place in a location mutually agreed upon by the parties. You may not proceed in a class, consolidated, or representative capacity in relation to any Dispute. Constant Contact reserves the right to seek injunctive relief in any court of competent jurisdiction for any irreparable harm.

Joining the Waitlist is entirely optional and voluntary. By registering, you only express an interest in purchasing a product or service and agree to be bound by these Waitlist Terms.
